Summary

DriverHelm is intended to be used by good-faith actors in countries where, being a product from the UK, it is legal to be used.

We reserve the right to refuse service to anyone we believe is using DriverHelm for illegal, or prohibited purposes.

The site is provided "as-is" - we make no guarantees about the accuracy of the data returned, or the quality of the service.

1. DriverHelm

DriverHelm (http://driverhelm.com, the "site", "website" or the "service") is a UK-based and UK-operating software-as-a-service website. Using DriverHelm means you accept the current Terms of Service, which may be altered or changed at any time, so do ensure you review these terms regularly.

You must be over the age of 18 to use this service, and may not access it from computers or access points in any country where the government of the United Kingdom has deemed it necessary to impose communications-related sanctions on or anywhere else where it may be illegal to do so.

2. Content

Content may be uploaded to the site by the owner of such works, or uploaded by a third party with express permission from the owner of said Content, and it is to be used for the sole purpose of utilising the website for its intended purpose.

The owners of Content which appears on DriverHelm retain all rights in regards to copyright, trademarks and service marks associated with their Content. DriverHelm does not claim any rights or ownership of Content uploaded by persons who are not directly involved with the site, as such it is the users' responsibility to ensure correct permissions are sought from the appropriate Content owners.

An account on DriverHelm does not guarantee any such license to use, in full or in part, any Content for the use of publication or dissemination to third parties.

3. Disclaimers and Limitation of Liability

DriverHelm is provided "as is" and offers no warranty, either express or implied, as to the availability of the site and/or any related services, fitness for any specific purpose or security of uploaded data or that of the hosting server. Nor do we warrant that the service will be error free or that defects will be corrected.

As such, we cannot be held liable for any form of consequential losses or damages as a direct, or indirect, result of use or misuse of DriverHelm, issues related to availability of the site or in the event of data loss, security breach, or corruption.

No compensation or acknowledgement shall be offered should a user suggest a feature, bug fix, correction or any other suggestion as it may already be under consideration or development by DriverHelm.

4. Usage

It is at DriverHelm's discretion to allow or block access of the site on a per-user basis, and further information may be asked of users wishing to gain access to the site to ascertain their suitability for the service, or access may be blocked, suspended, or terminated without notice if DriverHelm believes a user account to be acting maliciously or causing damage or harm to DriverHelm or other users.

If a breach of these terms is found, or a user is acting maliciously with regard to the site or other users, DriverHelm will take steps to suspend the user account which will immediately remove access to the site. Content posted to the site, as well as any subscriptions purchased, may in those circumstances become null and void, and no refunds shall be offered. We may, however, attempt to contact the parties involved to try and resolve the situation before this becomes necessary, but this is at DriverHelm's sole discretion.

You agree to not use this site to upload, share or otherwise pass or show to others Content which is deemed to be illegal in the United Kingdom, and any Content which breaches this rule shall be removed, with the offending user account being terminated immediately without notice or refund.
We will co-operate fully with authorities with regards to any breaches of the law.

Content may be removed if it is reported as having no relevance, being of an adult nature (defined as being pornographic or alluding to such activities), in otherwise bad-taste or considered "spam", however, we will attempt to contact the owners of said Content in the first instance in order to ascertain its suitability, if it is not deemed to be immediately necessary to remove it.

5. General

These terms shall be governed and interpreted in accordance with the laws of England and Wales, who shall have exclusive jurisdiction over any and all arising disputes.

Any terms contained herein which are deemed to be illegal, unenforceable or invalid by the laws of any country in which these terms are intended to be effective or superseded by any marked specific terms on individual pages of this site, then to the extent where it is deemed to be illegal, unenforceable, invalid or superseded it shall be severed and deleted from these terms, and all remaining terms shall survive and continue to be binding and fully enforceable.

A breach of any of these terms will result in your user account being terminated immediately with no notice or refund.

In the event of the sale of DriverHelm, or any part of it, to a third party, these terms shall be transferred to the new owners.

In the event of the closure of DriverHelm, or any part of it, these terms shall remain in effect until the end of the current billing cycle or the communicated closure date, whichever is sooner, and in the event you have a subscription to DriverHelm, you will be offered a refund for any unused time remaining on your subscription.
